4. Independent Third Parties

Best Brokers Australia is not an employer, partner, joint venturer, or legal agent of any broker or lender. Any contractual relationship, credit agreement, or advisory service is entered into strictly between you and the respective licensed broker or credit provider.

5. Exclusion of Responsibility

Best Brokers Australia is not liable or responsible for:

• Any credit advice, product recommendations, or assessments provided by third-party brokers;
• Any lending decisions, loan approvals, delays, condition requirements, or formal rejections made by credit providers;
• Interest rate changes, valuation variances, lender fees, or charges imposed by third parties;
• The acts, errors, or omissions of any broker, brokerage, or financial institution;
• The content, security, or terms of any third-party website linked from our platform; or
• Any dispute or contract between you and any broker or lender.

6. Limitation of Liability & Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other non-excludable statutory provision.

Subject to non-excludable statutory rights, our total aggregate liability arising out of or in connection with the platform, its tools, or these Terms — whether in contract, tort (including negligence), statute, or otherwise — is limited to the maximum extent permitted by law, and in no event shall exceed fifty Australian dollars (AUD $50.00).

• Reverse engineer, decompile, or attempt to derive source code from platform algorithms and software.

8. Intellectual Property

All intellectual property rights in the Best Brokers Australia platform — including text, logos, graphics, user interface designs, scenario algorithms, calculator engines, and code — are owned by or licensed to the platform operator. Technology by AIEX. All rights are reserved.

9. Indemnity

Listing Completeness scores reflect automated assessments of available online metadata on our platform and do not constitute an evaluation of professional competence, regulatory compliance, or credit advisory quality. Practice owners may update, claim, or request correction of their public directory profile at any time via our Contact & Directory Correction Portal.

13. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
